Acceptance of Terms
By accessing or using FIFTY2 ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. The Service is operated by Kurt Stawarz ("we," "our," or "us").
Description of Service
FIFTY2 is a web-based productivity and planning application designed to help you set goals, track habits, plan your weeks, and execute your strategy across 52 weeks. The Service includes features such as daily and weekly planning, goal tracking, habit monitoring, notes, calendar integration, and AI-powered planning assistance.
Account Registration
To use the Service, you must create an account using email/password or through a supported sign-in provider (Google, Microsoft, or Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Subscriptions and Payment
Access to FIFTY2 requires a paid subscription. Subscriptions are processed through our payment partner (Wix). By purchasing a subscription, you agree to the pricing and billing terms presented at the time of purchase. Subscription details, including pricing and renewal terms, are provided during the purchase process.
Your Content
You retain ownership of all content you create within the Service, including goals, tasks, notes, and other planner data. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. We do not claim ownership of your content.
AI Assistant
The Service may include an AI-powered assistant that provides planning suggestions, coaching, and insights based on your planner data. AI responses are generated by third-party AI providers and are intended as helpful suggestions, not professional advice. You should exercise your own judgment when acting on AI-generated recommendations.
Calendar Integration
If you connect your Google or Microsoft calendar, the Service will access your calendar events to display them within the planner. You can disconnect your calendar at any time through Settings. Calendar access is governed by the respective provider's terms and our Privacy Policy.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to store or transmit illegal, harmful, or objectionable content, attempt to gain unauthorized access to the Service or its systems, interfere with other users' use of the Service, or reverse engineer or attempt to extract the source code of the Service.
Service Availability
We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime.
Data and Backups
While we take reasonable measures to protect your data, you are responsible for maintaining your own backups of important information. We are not liable for data loss due to technical failures, account deletion, or other circumstances.
Intellectual Property
The Service, including its design, code, features, and branding, is the intellectual property of Kurt Stawarz and is protected by applicable copyright and trademark laws. The FIFTY2 name, logo, and "Hold the Week. Hold Your Year." tagline are our trademarks.
Limitation of Liability
The Service is provided "as is" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may cancel your account at any time by contacting us. Upon termination, your right to access the Service will cease, but we may retain your data for a reasonable period to allow for data export.
Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting a notice within the application or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles.
